  • Divorce Applications - $990+ (inc. GST) plus disbursements

    Service Description:
    We will assist you with your divorce application under the Family Law Act 1975 (Cth). This includes preparing and filing the application with the Federal Circuit and Family Court of Australia, advising you on eligibility and service requirements, and managing the process from start to finish. If you are filing a sole application, we will also assist with arranging service on the other party and appear at the divorce hearing where required (e.g. where children under 18 are involved).

    Scope of Work:

    - Review of your circumstances and confirmation of eligibility;

    - Preparation and filing of the Application for Divorce;

    - Advice on service, separation, and hearing requirements;

    - Service of documents (for sole applications);

    - Attendance at the hearing (if required).

    Fixed Professional Fee: $990 – $1,320 (incl. GST) depending on complexity (e.g. sole vs joint application, overseas marriage, substituted service).

    Court filing fee: $1,100 (payable directly to the Court – reduced fees may apply if eligible for concession).

    Further work outside the standard scope is billed at $440/hr (incl. GST) and discussed with you in advance.

  • Parenting Agreement - $880+ (inc. GST)

    Service Description:
    We will prepare a clear, child-focused Parenting Agreement tailored to your family’s needs, designed to help establish agreed arrangements for your children without the need for court orders. The agreement will set out key matters such as weekly time arrangements, holidays, communication, and decision-making responsibilities. This type of agreement is useful where both parents wish to co-parent cooperatively and avoid litigation, and may also serve as a helpful interim arrangement while court proceedings or mediation are pending.

    Scope of Work:

    - Taking instructions regarding parenting history and desired arrangements;

    - Drafting a Parenting Agreement that includes provisions for changeover, school holidays, birthdays, communication, medical decisions, and dispute resolution;

    - Revisions to reflect any feedback or changes requested;

    - Option to support informal negotiations with the other parent, where appropriate.

    Fixed Professional Fee: $880 – $1,320 (incl. GST) depending on the level of complexity and whether negotiation assistance is required.

    Additional work beyond the drafting scope (e.g. mediation, court proceedings, or enforcement advice) is charged at $4400/hr (incl. GST).

  • Financial Agreement (Re-Relationship, Post-Separation or De Facto etc.) - $2,500+ (inc. GST)

    Service Description:
    We will prepare a Binding Financial Agreement under the Family Law Act 1975 (Cth) to formalise the division of assets, liabilities, and superannuation between you and your former partner. This agreement ensures that both parties are legally bound by the agreed financial settlement and prevents future claims. It can be used in de facto or married relationships (before or after separation), and provides a private and cost-effective alternative to court orders.

    Scope of Work:

    - Taking detailed instructions regarding your asset pool, contributions, and agreement with the other party;

    - Drafting a tailored Financial Agreement reflecting the terms of settlement;

    - Providing legal advice as required under section 90B, 90C or 90D (or section 90UB, UC or UD for de facto parties);

    - Coordinating execution and providing the required Certificate of Independent Legal Advice;

    - Liaising with the other party or their solicitor if necessary.

    Fixed Professional Fee: $$2,500 (incl. GST) depending on complexity, number of assets, and whether the other party is legally represented.

    Note: The quoted fee is based on instructions and assumes the terms are agreed or largely agreed. If significant negotiations or changes arise, further costs may apply and will be discussed with you in advance.

    Additional work (e.g. complex structures, tax issues, or liaising with third parties) is charged at $440/hr (incl. GST).

  • Application for Consent Orders (Parenting and/or Property) - $2,500+ (inc. GST) plus disbursements

    Service Description:
    We will prepare an Application for Consent Orders and supporting Minute of Consent Orders to formalise your agreement with the other party regarding parenting arrangements, property settlement, or both. Consent Orders are filed with the Federal Circuit and Family Court of Australia and, once made, have the same legal effect as orders made by a judge after a hearing — but without the need for court attendance. This service provides a cost-effective, binding and enforceable resolution to family law matters by agreement.

    Scope of Work:

    - Taking your instructions regarding the agreed parenting or property arrangements;

    - Preparing the required Court forms, including the Application for Consent Orders and Minute of Proposed Orders;

    - Ensuring the agreement meets the Court’s legal requirements (e.g. just and equitable in property matters, or in the best interests of the child in parenting matters);

    - Liaising with the other party or their lawyer if necessary to finalise terms;

    - Filing the documents with the Court and providing you with sealed copies once orders are made.

    Fixed Professional Fee:

    Parenting or Property only: $2,500+ (incl. GST)

    Parenting and Property combined: $3,300+ (incl. GST)
    (Court filing fee: $200, payable separately to the Court)

    Further work beyond the scope (e.g. negotiation, complex drafting, or responding to Court requisitions) is charged at $440/hr (incl. GST) and will be discussed in advance.

  • Binding Child Support Agreements - $1,650 (inc. GST)

    Service Description:
    We will prepare a Binding Child Support Agreement (BCSA) under the Child Support (Assessment) Act 1989, which sets out the agreed child support arrangements between you and the other parent. A BCSA allows parents to privately agree on periodic and non-periodic child support (e.g. school fees, health insurance, extracurricular costs) and is legally binding once properly executed with independent legal advice. It provides certainty and flexibility beyond the formula assessment from Services Australia.

    Scope of Work:

    - Taking detailed instructions regarding the proposed child support terms;

    - Drafting the BCSA, including any periodic payments, lump sums, and additional contributions (e.g. education, medical, extracurricular);

    - Providing the required independent legal advice and issuing the Legal Certificate;

    - Liaising with the other party or their solicitor if needed to finalise terms and execution;

    - Ensuring compliance with the legislative requirements for enforceability.

    Fixed Professional Fee:
    $1,650 – $2,200 (incl. GST)
    (Assumes terms are largely agreed and both parties are legally represented)

  • Advice on Binding Financial Agreements and Consent Orders - $990 (inc. GST)

    Service Description:
    We will review and provide you with independent legal advice on a proposed Binding Financial Agreement (BFA) or Consent Orders prepared by the other party or their lawyer. This includes advice on your rights and entitlements under the Family Law Act 1975 (Cth), the legal effect of the document, and the advantages and disadvantages of entering into the agreement. Where required, we will also complete the legal advice certificate necessary for the agreement to be binding and legally enforceable.

    Scope of Work:

    - Reviewing the draft Binding Financial Agreement or Consent Orders (and Application, if applicable);

    - Advising you on the legal effect of the agreement, including how it alters or finalises your rights;

    - Identifying any unfair or risky terms, and recommending amendments where appropriate;

    - Explaining the consequences of signing the document, including finality and enforceability;

    - Issuing the required Certificate of Independent Legal Advice (for BFAs);

    - Providing written confirmation of advice, if requested.

    $990 – $1,650 (incl. GST) depending on the complexity of the agreement and whether further negotiation or amendment is required.

    Work beyond the scope (e.g. complex negotiations, redrafting, or alternative proposals) is billed at $440/hr (incl. GST) and will be discussed with you in advance.
